Welcome to McCabe’s. These Terms & Conditions explain the basic rules for using our website, buying from us online, purchasing concert tickets, contacting us about lessons or repairs, and interacting with McCabe’s online.

We are McCabe & Camp, Corp., doing business as McCabe’s Guitar Shop (“McCabe’s,” “we,” “us,” or “our”).

By using this website, creating an account, placing an order, buying a ticket, submitting a form, or otherwise interacting with us online, you agree to these Terms & Conditions.

If you do not agree, please do not use the website. You may still visit the shop in person, where the guitars are less pixelated.

1. Use of This Website

You may use this website for lawful purposes related to McCabe’s products, services, concerts, lessons, repairs, and general information.

You agree not to:

  • Use the website for unlawful, fraudulent, abusive, or harmful purposes
  • Interfere with the operation or security of the website
  • Attempt to access systems, accounts, or information that you are not authorized to access
  • Submit false, misleading, abusive, or harmful information
  • Copy, scrape, or misuse website content in a way that harms McCabe’s or violates applicable law
  • Use the website to transmit malware, spam, or other harmful code or content

We may suspend or limit access to the website if we believe someone is misusing it.

2. Website Content

We try to keep information on the website accurate and current, including product descriptions, prices, availability, event information, lesson information, and repair information.

Even so, mistakes can happen. We may correct errors, update information, cancel orders affected by errors, or change website content at any time.

Website photos, descriptions, prices, availability, and specifications are provided for general information. For instruments and other unique items, condition, color, tone, feel, and appearance may vary.

3. Online Store Orders

When you place an order through our website, you are making an offer to purchase the items in your cart. An order is not final until we accept and process it.

We may refuse, cancel, or limit an order for reasons including:

  • Product unavailability
  • Pricing or description errors
  • Suspected fraud or misuse
  • Payment problems
  • Shipping restrictions
  • Errors in customer information
  • Other reasonable business or legal reasons

If we cancel an order after payment has been processed, we will issue an appropriate refund.

4. Product Availability

Some products may be available in limited quantities. Some items may be one-of-a-kind, used, vintage, handmade, consigned, special order, or otherwise not easily replaceable.

We do our best to keep online inventory accurate, but availability is not guaranteed until an order is confirmed and fulfilled.

5. Prices, Taxes, and Payment

Prices are listed in U.S. dollars unless otherwise stated.

We may change prices at any time. The price charged for an order should be the price shown at checkout, plus applicable taxes, shipping, handling, or other disclosed charges.

You agree to provide accurate billing and payment information. Online payments are processed by third-party payment processors. McCabe’s does not intentionally store full credit card numbers on our website servers.

6. Shipping and Delivery

Shipping options, costs, and estimated delivery times may vary by product, destination, carrier, and order details.

We will make reasonable efforts to ship orders within the timeframe stated at checkout or on the applicable product page. If no specific shipping timeframe is stated, we will ship within a reasonable time.

Delivery dates are estimates, not guarantees, unless we expressly say otherwise in writing.

Shipping, delivery, lost packages, damaged shipments, returns, and related issues are governed by our Returns & Shipping Policy.

7. Returns and Exchanges

Returns, exchanges, refunds, and shipping-related issues for store merchandise are governed by our Returns & Shipping Policy.

Concert tickets are not returnable or exchangeable. ALL CONCERT TICKET SALES ARE FINAL. There are no customer-initiated refunds, no customer-initiated exchanges, and no customer-initiated cancellations at any time. No exceptions.

Some other items may also be final sale or subject to special return limits, including used instruments, vintage instruments, special orders, consignment items, clearance items, opened accessories, lesson purchases, repair work, or other items identified at the time of sale.

Nothing in these Terms limits any non-waivable rights you may have under applicable law.

8. Instrument Warranty and Trade-Up Policy

Certain stringed instruments may be eligible for McCabe’s instrument warranty and trade-up program, as described at the time of purchase or in a separate Instrument Warranty & Trade-Up Policy.

Eligibility, exclusions, maintenance coverage, trade-up value, proof-of-purchase requirements, condition requirements, time limits, and other details may vary by product and purchase.

Not every product qualifies. Used instruments, vintage instruments, consignment items, clearance items, special orders, modified instruments, damaged instruments, and instruments sold “as is” may be excluded unless McCabe’s states otherwise in writing.

Nothing in these Terms expands, reduces, or replaces any written warranty provided at the time of sale, any manufacturer warranty, or any non-waivable rights under applicable law.

9. Concert Tickets and Events

ALL CONCERT TICKET SALES ARE FINAL. There are no customer-initiated refunds, no customer-initiated exchanges, and no customer-initiated cancellations at any time. No exceptions.

Please review the event date, time, artist, ticket quantity, attendee information, and order details carefully before completing your purchase.

McCabe’s is not responsible for mistaken purchases, duplicate purchases, scheduling conflicts, illness, travel problems, weather, traffic, parking issues, artist preference changes, or other circumstances that prevent a ticket holder from attending.

Tickets may not be returned or exchanged for another event, date, showtime, store credit, merchandise, lessons, repairs, or any other product or service.

Event dates, times, artists, lineups, seating arrangements, and policies may change.

If McCabe’s cancels, postpones, reschedules, or replaces an event, McCabe’s will handle the matter as required by applicable law.

McCabe’s may refuse admission or remove attendees who violate venue rules, disrupt the performance, interfere with artists, staff, or other patrons, or fail to follow reasonable staff instructions.

Taking photographs and all other forms of recording are prohibited during concerts at McCabe’s unless McCabe’s expressly allows otherwise.

10. Lessons, Classes, and Workshops

Lesson, class, and workshop information on the website is provided for general information and scheduling purposes.

Teacher availability, lesson times, prices, formats, and policies may change.

Cancellations, rescheduling, missed lessons, refunds, credits, and related issues are governed by the lesson, class, or workshop policy provided at the time of booking or purchase.

If the participant is a minor, a parent or guardian should complete any online inquiry, registration, or purchase.

11. Repairs

Repair information on the website is provided for general information.

Repair estimates are estimates only unless McCabe’s expressly states otherwise in writing. Final cost and timing may depend on the actual condition of the instrument, parts availability, repair complexity, approval of additional work, and other factors.

Customers are responsible for providing accurate contact information and picking up instruments when work is complete.

Repair terms, estimates, storage, abandoned property, declined work, payment requirements, and warranty or guaranty terms may be governed by separate repair policies, repair tickets, or written communications.

Repair Guaranty

For repair work performed by McCabe’s, the following guaranty applies unless McCabe’s provides different written terms for a particular repair:

We guaranty only that the parts installed by us will perform satisfactorily under conditions of normal usage for a period of ninety days after date of repair. EXCEPT AS EXPRESSLY PROVIDED ABOVE, THERE IS NO WARRANTY OR GUARANTY OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, OR OF ANY OTHER KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICES PERFORMED OR PARTS FURNISHED BY US, and we do not, of course, make any guaranty with respect to any other parts. If repairs later become necessary due to other defective parts, they will be charged separately.

This repair guaranty is separate from McCabe’s Instrument Promise, manufacturer warranties, and any non-waivable rights a customer may have under applicable law.

12. Accounts

Some website features may allow you to create an account.

You are responsible for keeping your account login information confidential and for activity under your account. Please contact us promptly if you believe your account has been accessed without permission.

We may suspend or close accounts if we believe they are being misused or if required for legal, security, or business reasons.

13. Email, Newsletter, and Communications

If you sign up for our mailing list, we may send you emails about concerts, products, lessons, repairs, store news, events, and promotions.

You can unsubscribe from marketing emails using the unsubscribe link in the email.

We may still send non-marketing messages, such as order confirmations, ticket information, customer service replies, repair updates, account notices, and policy updates.

14. Gift Cards, Discounts, and Promotions

Gift cards, discounts, coupons, store credits, and promotions may be subject to additional terms, expiration rules, exclusions, limits, and availability.

Promotions may not apply to all products or services. We may modify or end promotions at any time, unless otherwise stated or required by law.

15. Intellectual Property

The website and its content, including text, images, graphics, logos, designs, audio, video, and other materials, are owned by McCabe’s or used with permission.

You may view and use the website for ordinary personal use. You may not copy, reproduce, distribute, modify, sell, or exploit website content without permission, except as allowed by law.

McCabe’s name, logos, designs, and related marks may not be used without our permission.

16. User Submissions

If you submit comments, reviews, photos, messages, testimonials, feedback, or other content to us, you are responsible for making sure you have the right to submit it.

You agree not to submit content that is unlawful, false, misleading, defamatory, abusive, infringing, obscene, harassing, or otherwise harmful.

By submitting content to us, you give McCabe’s permission to use, reproduce, display, edit, and share that content for reasonable business purposes, including customer service, website operation, marketing, and promotion, unless we agree otherwise in writing.

We may remove or decline to use submitted content at our discretion.

For used, vintage, handmade, or unique instruments, personal inspection and in-store testing are strongly encouraged when possible.

We provide the website and its content on an “as is” and “as available” basis.

We do not guarantee that the website will always be available, uninterrupted, secure, or error-free.

Except for written warranties expressly provided by McCabe’s, product manufacturers, or applicable law, we disclaim warranties to the fullest extent permitted by law.

Nothing in these Terms limits any warranty, return right, consumer protection, or other legal right that cannot be waived under applicable law.

21. Limitation of Liability

To the fullest extent permitted by law, McCabe’s will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the website, online purchases, delays, website errors, third-party services, or inability to use the website.

To the fullest extent permitted by law, our total liability for a claim related to an online purchase will not exceed the amount you paid for the product or service giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited.

You agree to indemnify and hold harmless McCabe’s, its owners, officers, employees, contractors, agents, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your misuse of the website, violation of these Terms, violation of law, or violation of another person’s rights.

Your continued use of the website after changes are posted means you accept the updated Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

Any disputes that are not resolved informally will be handled in the state or federal courts located in Los Angeles County, California, unless applicable law requires otherwise.
